Service agreement terms and conditions
General principles
Drive On Therapy will provide a range of services as described in these terms and conditions. These terms and conditions are to be read in combination with the Drive On Therapy cancellation policy, and Drive On Therapy pricing policy. Together, these terms and conditions and the above policies form a legal document, where Drive On Therapy and the client agree to:
- Treat each other, their resources and property with mutual respect
- Abide by Drive On Therapy policies and procedures
- Adhere to all relevant legislative requirements and standards
- Review the provision of services outlined in the service agreement at agreed intervals
- Reasonably mitigate any health and safety risks at the location of services
- Pay all relevant invoices on time, understanding that failure to do so may result in services being suspended or cancelled.
Description of services
Drive On Therapy offers a range of services including, although not limited to Occupational Therapy Driving Assessment, Occupational Therapy Capacity Building and Specialised Driver Training. The client agrees to receive services along the following lines:
- A schedule of support will be created to outline the services to be provided within a nominated period
- Hours of support may be used flexibly across services noted in the schedule of support
- The services provided by
Drive On Therapy may include, although are not limited to the following:- Direct (face-to-face) assessment and intervention including telehealth
- Session planning and documentation including case notes, reports and equipment applications
- Development of therapy plans, and progress and outcome reports
- Resource development.
Drive On Therapy provides services to privately funded clients, and NDIS participants who are self and plan-managed. It is understood by the client that Drive On Therapy can claim for the following supports when appropriate:
- All services as described above
- Provider travel (the time and kilometres taken to travel to and/ or from our place of business to you)
- Non-face-to-face support provision (time taken liaising with you or an important stakeholder involved in the supports we deliver, for example phone calls and emails)
- Reports requested by funding bodies such as the NDIS.
Client responsibilities
Whilst accessing services from Drive On Therapy, the client will comply with the
following responsibilities:
- Treat staff with courtesy, respect and consideration at all times
- Provide honest and transparent information throughout services
- Participate in the process of developing therapy goals and strategies, and reviewing progress with your occupational therapist at agreed intervals
- Provide information to Drive On Therapy about your needs and preferences for services before commencing, to ensure we can appropriately support you
- Talk to Drive On Therapy about any concerns you have about the service
- Advise Drive On Therapy of any changes to your NDIS plan or other funding arrangements that may impact the delivery of services.
Responsibilities of Drive On Therapy
Drive On Therapy will undertake the following:
- Discuss this agreement with you, your representative, family or other important people in your life as requested
- Keep you informed about your services regularly and answer your questions as soon as possible
- Listen to you and resolve any matters or concern related to Drive On Therapy services in a timely manner
- Keep accurate and confidential records of the services we provide to you
- Not share your personal information with others without your written or verbal consent, unless required by law, or where your safety or the safety of others is at risk
- Provide you with access to relevant policies and procedures as requested
- Effectively manage risks in relation to hazardous, critical and emergency events.
Payment arrangements
Drive On Therapy will undertake the following:
- Privately paying clients will pay the entire fee for an Occupational Therapy Driving Assessment no less than seven (7) days prior to the appointment. Failure to make payment by the required time may result in the appointment being cancelled
- Invoices will be issued by Drive On Therapy within seven (7) days following completion for all other services. Payment is required by the client within fourteen (14) days from the date of the invoice. The payment can be directed to a nominated plan manager if this information is provided by the client. The client accepts personal liability for any Drive On Therapy charges accrued through services that are not recoverable through their plan manager, account manager, or funding body such as the NDIS. Drive On Therapy may take legal action required to recover unpaid monies. Failure to pay an invoice will result in services being placed on hold and possibly cancelled
- Unless otherwise indicated in the schedule of supports, all Drive On Therapy services are GST exempt.
Pricing limits
Drive On Therapy will match the rates applicable for occupational therapy in the NDIS price guide. The NDIS price guide is updated regularly, taking into account adjustments for indexation and other costs. Drive On Therapy will automatically apply any change to rates according to updates in the NDIS price guide. Drive On Therapy will advise the client of an increase to pricing prior to implementing a change.
The current rate for occupational therapy services is $193.99 per hour and $0.99 per kilometre travelled to deliver the service.
Sometimes it is essential for services to be delivered in collaboration with other stakeholders, such as a driving instructor, vehicle modifier or equipment supplier independent to Drive On Therapy. In most cases these fees are covered through the NDIS as stipulated in the NDIS operational guidelines for vehicle modifications and driving supports. Any fees that may be incurred by external stakeholders to Drive On Therapy will be discussed with the client prior to commencing.

Travel fees
Drive On Therapy is a community occupational therapy provider where travel may be necessary to deliver services at your preferred location. Drive On Therapy will invoice for payment of travel by the occupational therapist to provide your service at your preferred venue, in accordance with arrangements as outlined in the schedule of supports. All estimated travel costs will be provided to you prior to commencing services with Drive On Therapy.
In line with the current NDIS price guide, Drive On Therapy will charge for travel as follows:
- When travelling to a client location from the usual place of work, a maximum of 30 minutes in MMM1-3 geographical areas and a maximum of 60 minutes of time in MMM4-5 geographical areas
- When travelling from a client location back to the usual place of work, a maximum of 30 minutes in MMM1-3 geographical areas and a maximum of 60 minutes of time in MMM4-5 geographical areas
- Travel costs may be reduced by sharing them between clients, if the occupational therapist can cluster services to deliver to clients within a close proximity
- Non-labour fees (including kilometres travelled).
Variations and reviews
Drive On Therapy and the client agree to the following regarding variations and reviews of the service agreement:
- The client may amend the services provided in the schedule of support by discussing this with Drive On Therapy. A revised agreement will be issued to the client when any such mutually agreed variations are made
- The service agreement will be valid for 12-months or the expiration of the NDIS plan (whichever comes first). All services will be reviewed at the conclusion of the service agreement. A new service agreement will be developed for the following period.
Cancellation & refunds
Drive On Therapy may rarely cancel a service due to unforeseen circumstances. On such occasions the client will not be charged, and every effort will be made to schedule a new appointment at a time suitable.
The client will not be charged or will be issued a refund by Drive on Therapy for a scheduled service if they cancel with more than two (2) clear business days notice. This is referred to as a long notice cancellation.
Where the client provides us with a short notice cancellation, Drive On Therapy will claim 100% of the fee associated with the service. This fee includes session preparation, travel, direct (face-to-face) therapy time, case noting and reporting that was associated with the scheduled service. A short notice cancellation is considered the following:
- Failing to attend a scheduled appointment at the agreed location, within a
reasonable timeframe - Providing less than two (2) clear business days’ notice to reschedule or cancel
an appointment.

Confidentiality and privacy
Consent to share client information will be gathered at the point on onboarding for services with Drive On Therapy. No confidential information may be disclosed by Drive On Therapy or the client, except for the following circumstances:
- Where the information is required for the purposes of delivering the requested services (for example, providing client contact details to gather a quotation)
- With the consent of the relevant party, such as the client or Drive On Therapy
- Drive On Therapy will report to the driver licensing authority (Department of Transport) if there are concerns regarding fitness to drive and client is either:
- Unable to appreciate the impact of their medical condition or disability
- Unable to take notice of the recommendations due to cognitive impairment
- Provides unreliable information on their condition
- Continues driving despite appropriate advice and is likely to endanger the public.
Feedback, complaints and dispute resolution
Drive On Therapy welcomes all forms of feedback including although not limited to compliments, complaints, disputes and suggestions. Please contact Drive On Therapy to provide all forms of feedback appropriate to our services. We will liaise with you directly regarding any disputes to reach an appropriate resolution.

Liability
Under no circumstances will Drive On Therapy be held liable for any direct, indirect, punitive, incidental, special, consequential or any other damages whatsoever including, but not limited to, damages arising out of or in any way connected with the provision of or failure to provide services, or for any information or advice obtained from Drive On Therapy.
Termination of services
If the client or Drive On Therapy wishes to end services, both parties agree to give four (4) weeks’ notice in writing to the other party.
If either party seriously breaches the terms and conditions stipulated with this service agreement, the requirement of notice may be waived.
